D I S C L A I M E RBy applying for a commission, you are agreeing to the following terms between you the client, and I the artistThis agreement is between migi (the "Artist") and you (the "Client").Please read carefully, and direct any questions to: [email protected]

GENERAL
✦ Prices can be changed depending on complexity of work.
✦ Stream Assets (e.g. include but not limited to emotes, badges, overlays, etc.) are created solely for the client and may be used on their own platforms (etc. Twitch, Youtube, Discord, Twitter, etc).
✦ If you, the client, requests characters of IPs not belonging to them (e.g. fanart of existing characters), they are solely responsible for the use of commissioned work. The artist holds no responsibility for DMCA claims due to the use of copyrighted characters.
✦ You, the client, may display the completed commission on external websites as long as credit linking back to the artist’s website or social media is clearly visible.

PAYMENTS
✦ Invoices must be paid within 72 hours upon receiving the invoice unless informed prior that this is not possible, if this is not met the commission may be cancelled. The Artist will not start on the Work until full payment has been made.REVISIONS
✦ As outlined in the timeline, there are set revision moments.
✦ At the start of a revision moment, the Artist will provide all files that the Client is expected to inspect.
✦ The Client is expected to provide their feedback in one go, either in a long message or a document. Please make sure that the feedback is complete!
✦ The Artist will incorporate the feedback into the Work and will continue onto the next stage immediately.
✦ After a revision moment, no changes can be made to previous stages of which the revision moment has already been past.
✦ If during a revision moment the Client does not reply within 1 month, the Artist has the right to continue onto the next stage. The revision moment will be past. (Please check your VGen frequently!)
✦ The Artist retains the right to refuse further revisions (and move on to the next stage) if the amount or severity of the revisions pushes the Work far outside of a reasonable project scope for this type of commission.DEADLINES AND DELIVERY
✦ Once the commission has been accepted, I will aim to complete the commission within 1-3 months after you've received the first sketch.
✦ Client commission position can be viewed on my VGen Work Queue. If I cannot complete it within the designated timeframe, I will ensure to get in contact with any delays to the client.
✦ A rush fee option is available, however it will cost 50% of the commission and the deadline will depend on how much work is being completed.USAGE RIGHTS
✦ The Client owns commercial rights to the Work. This includes stream and content creation usage.
✦ The Client does NOT own merchandising rights to the Work. Selling merchandise of the Work is strictly forbidden without the proper license purchased. The only exception to this rule is clipping the Work into emotes to be used on Twitch/Youtube (but NOT to put those emotes up for further sale).
✦ Modification or tracing of the Work for commercial use (by anyone other than the Artist) is not allowed.
✦ The Client will make an attempt to credit the Artist in an easy-to-find place for any viewers of the Client's content.
✦ The Artist has full rights to use the Work for portfolio purposes. This extends to the right to showcase the Work during the creation process. If the Client wishes for the Work to remain secret before a specified date, the resulting NDA will overrule this right until that date and a privacy fee will apply.
✦ Using the Work for AI training, or NFT-related purposes is not allowed.
✦ Reselling the Work is not allowed, unless explicit permission has been given by the Artist.REFUNDS
✦ Once work has begun, there will be no refunds.
✦ A refund will only happen in the case that I am unable to complete your commission and have not yet started the commission within 2 months.
✦ I reserve the right to cancel the commission if I deem that the client is behaving inappropriately or violates the TOS.CLARITY
